1. Who you are buying from

This website, soonerased.com (the “Site”), is operated by SOON ERASED LTD, a company registered in England and Wales under company number 16692885, trading as Soon Erased (“Soon Erased”, “we”, “us”, “our”).

These terms of sale apply to every purchase of an artwork through the Site. They sit alongside our Terms of use and our Privacy policy. Nothing in these terms affects your statutory rights as a consumer.

We sell artworks as agent for the artists we represent: each sale is of a physical, original work (or a numbered edition, where stated). Design and marketing services from the Soon Erased studio are not sold under these terms — they are quoted and contracted separately in writing.

2. How a purchase works

Prices are displayed on every work, and there are two ways to buy, depending on the work and on where it is going:

• Card checkout. Where a work shows a Buy now button, you can pay by card through the Site. Checkout is for delivery addresses in the United Kingdom only.
• Enquiry and invoice. Every work can also be enquired about, and some are sold this way only — works with no listed price, works already sold, and every delivery outside the United Kingdom. An enquiry is not an order and does not commit you to anything. If the work is available, we confirm the total price — including delivery, which we agree with you before invoicing — and issue an invoice. That invoice is our offer to sell, and a binding contract is formed when you pay it.

Display of a work on the Site is an invitation to deal, not a binding offer. When you pay at checkout you are making an offer to buy, and a binding contract is formed when we email you to confirm the order — not at the moment your card is charged.

Every original is one of a kind, so on rare occasions two people may pay for the same work moments apart, or a work may be shown as available when it has just sold. If that happens, the first completed payment takes the work and we refund the other in full to the original payment method as soon as we become aware, normally within one working day. You will owe nothing.

3. Prices and payment

All prices are in pounds sterling. We are not currently registered for VAT, so no VAT is added to or included in our prices; if we become VAT-registered, invoices will say so clearly.

Card payments are processed for us by Stripe. Your card details are entered on Stripe’s own secure payment page — they are never received, seen or stored by us or by the Site. Delivery is added as a separate line before you pay, so the total you approve at checkout is the total you are charged. Where a sale is handled by invoice instead, payment is by the method stated on the invoice, typically bank transfer.

4. Delivery

Delivery within the United Kingdom is charged at checkout according to the size of the work, and the amount is shown to you before you pay. Where a sale is handled by invoice, the cost, method and estimated timing are agreed with you and appear on the invoice. Delivery estimates are given in good faith but are estimates. For deliveries outside the United Kingdom — which are by enquiry only — you are responsible for any import duties, taxes or customs charges of the destination country.

The work is at our risk until it is delivered to the address you gave us, at which point risk passes to you. Ownership (title) of the work passes to you once we have received payment in full and the work has been delivered.

5. Your right to cancel (consumers)

If you are buying as a consumer, you have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your purchase within 14 days after the day the work is delivered, without giving a reason.

• To cancel, tell us in writing within that period — hello@soonerased.com is easiest.
• Return the work within 14 days of telling us you are cancelling, to the address we give you when you cancel. The work must come back in the condition it left us, packed with reasonable care. You are responsible for the cost of the return and for the work while it is in transit back to us, so we recommend insured shipping.
• We will refund the full price, including the original delivery cost (at the standard rate we charged), within 14 days of receiving the work back — or of you providing proof of return shipment, whichever is earlier. We may reduce the refund to reflect any diminished value caused by handling beyond what was necessary to inspect the work.

This cancellation right does not apply to a work that is commissioned or personalised to your specification; we will tell you clearly before you pay if that is the case for a particular purchase.

You do not have to use this form, but you can. Copy it into an email to hello@soonerased.com and fill in the blanks:

6. If something is wrong with the work

Under the Consumer Rights Act 2015, the work must match its description and be of satisfactory quality. Every work is described honestly and in plain English, and condition is stated where relevant. Original artworks are hand-made objects: minor variations in surface and texture are part of the work, and small differences between on-screen colour and the physical work are normal — neither is a defect.

If a work arrives damaged, or is genuinely not as described, tell us within a reasonable time (ideally with photographs, within 48 hours of delivery for transit damage — it makes the carrier claim much easier). You will have the remedies the law gives you, including repair, replacement where possible, or a full refund including delivery and return costs.

7. Copyright in the work

Buying a work transfers ownership of the physical object only. Copyright stays with the artist. You may display the work privately, resell it, and photograph it for personal, non-commercial purposes; you may not reproduce it commercially (prints, merchandise, licensing) without the artist’s permission — we are happy to make the introduction.

8. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under the law of England and Wales, and nothing in them affects your statutory rights. Subject to that, our total liability to you in connection with a purchase is limited to the price you paid for the work plus any delivery charges, and we are not liable for indirect or consequential loss.

9. Governing law

These terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the UK you may bring proceedings in your home nation and you keep the protection of its mandatory consumer rules.
